Before covered use, 6 RCNY §5-303 requires the employer or employment agency to make the most recent audit date and a summary of results publicly available in a clear and conspicuous manner. The summary includes the data source/explanation, unknown-category count, applicant/candidate counts, applicable selection or scoring rates, impact ratios, and the distribution date.
Required publication fields
| Field | Publication requirement |
|---|---|
| Most recent audit date | Publicly available before use |
| Data source and explanation | Included in summary |
| Unknown-category count | Included in summary |
| Counts and applicable rates | Included for all required categories, subject to rule provisions |
| Impact ratios | Included for required categories |

Can the result live on another website?
Yes. The rule allows an active hyperlink to a website containing the required summary and distribution date if the link is clearly identified as a link to the bias-audit results.
How long must it remain posted?
The employer or employment agency must keep the summary and distribution date posted for at least six months after its latest use of the AEDT for an employment decision.
Frequently asked questions
The rule permits an employer or agency to satisfy publication through a clearly identified active hyperlink to a website containing the required information. The employer/agency remains responsible for its obligation.
The rule focuses on making the required information publicly available in a clear and conspicuous manner. A PDF may be part of that publication strategy, but accessibility, stable linking and the required content should be reviewed.
The public summary should contain the required public information, not raw candidate data, internal logs or confidential evidence.
